BAR ASSOCIATION OPPOSE LEGAL AMENDMENTMadikeri Feb. 20: Madikeri bar association has opposed the proposed legal amendment by the central Govt. All the advocates raised their voice against this in the general body held here .A detail memorandum has been sent to the central law minister. The association has taken a decision on the clear guidance from the New Delhi all India bar association and Bangalore Karnataka associations. Association has explained the adverse affect of the proposed Amendment. We are concerned of the disastrous consequences of the amendment to section 41 and 309 of the Cr.PC. and section 2 of the Limited Liability Partnership Act said B.J. Chinnappa the association president and K.D.Dayananda ,the general secretary in a press conference here.They continued follwing version At the out set we feel that if it is the intention of the Government to amend. Section 309 of the I .P.C. for the purpose of for early disposal of such case the union Govt. has not considered the other aspects available for speedy disposal of offences of the above nature. One such way is to constitute special courts to deal with heinous offences of the above nature or giving 5 Or days time to an accused to engage another Advocate or passing over such cases where defense counsel are engaged in other courts till he finishes his work in other courts, or posting of such cases to the next day. These or simple accommodation which will not hamper progress of the cases.-: if a bare statement of a witness is taken into consideration as evidence against the accused and judgment is pronounced, it can not by any stretch of imagination be called justice . Besides section 303 of Cr.P.C, postulates and confers a right upon the accused to be defended by a pleader of his choice. If invoking the provisions of proposed amendment and judgment is pronounced against an accused without being defended by a pleader of his choice, would not only offend section 303 of Cr.RC, but also offends fair trial and dispensation of justice. Further the proposed amendment of section. 41 of CRPC. is further more draconian in nature. it is possible that an innocent person could be prosecuted in his absence and without the assistance of a counsel could he convicted only on the basis of the statements recorded in his absence and sentenced up to 7 years. Snch a person could he apprehended unawares and incarcerated, would it not tanamount to mockery of justice? Bar association has questioned. NO SOLVATION TO TIBET PROBLEMH.H. DALAI LAMA Madikeri Feb.20: Tibetan spiritual head Dalai Lama arrived at Bailukuppe, Tibetan centre in kodagu border area.. He was welcomed by Tibetan citizens and students in a traditional Tibetan style and was then taken to the camp. The Tibetans dressed in their traditional attire, gathered in large number to welcome their religious head, Dalai Lama who will be living in the camp for about 15 days. He visited this camp after 2 years. Addressing the reporters, Dalai Lama said that the long pending decision about the Tibetan land in China is ever unsolved. He has no hope that this will be settled. Tibetans are grateful to the Kannada land which provided space and opportunity to Tibetans to settle since 5 decades. to live and, to retain their own culture. He said that the help of India will never be forgotten by the Tibetans. Dalai Lana said that Bailukuppe has become a great Buddhist centre in India as some of the biggest Buddhist temples, Tibetan schools and other institutions established here. Over 10.000 Buddhist are living here. Photo:DAL;AI LAMA IN TIBETAN COLONY UKG student drove ExcavatorMadikeri feb.20: Sumer,four and a half years of age studying in UKG drove the excavator weighing three tones, for 30 minutes without anybody’s help. “He learnt handling the excavator just by observing the functioning of the driver. After exercising twice, now, he independently manages it,” disclosed Mohammed Akram, a relative of the boy Sumer is the son of Syed Sadik and Arifa Banu of Virajpet town. He is UKG student of Vinayaka English Medium School in Virajpet. |
